PRAYER :- For Bail in Crime No.548 of 2023 on the file of the respondent police. 1/4
ORDER : The Court made the following order :- The petitioners/Accused Nos.1 and 2, who were arrested on 01.08.2023 for the alleged offence under Sections 4(1)(a) r/w. 4(1-A) of Tamil Nadu Prohibition Act, in Crime No.548 of 2023, on the file of the respondent Police, seeks bail. 2.The case of the prosecution is that on 01.08.2023, when the defacto complainant along with his Police team were in their routine patrol duty, the petitioners were found in illegal possession of 10 brandy bottles. Hence, the complaint.
3.The learned counsel for the petitioners would submit that the petitioners are innocent and they have been falsely implicated in this case. The petitioners are in custody from 01.08.2023. Hence, prays to release them on bail. 4.The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioners are not having any previous cases at their credit. 5.Considering the facts and circumstances of this case and considering the 2/4
period of incarceration and there is no previous case pending against the petitioners, this Court is inclined to grant bail to the petitioners with certain conditions. 6.Accordingly, this Criminal Original Petition is allowed and the petitioners are ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Orathanadu, and on further condition that the petitioners shall report before the respondent police daily at 10.30 a.m. until further orders.
