PRAYER :- For Bail in Crime No.48 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/3rd Accused herein, who was arrested on 26.05.2023 for the alleged offence under Sections 302 of IPC @ 302, 109 and 201 of IPC, in Crime No.48 of 2023, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the defacto complainant lodged a complaint before the respondent police stating that on 26.05.2023, at about 6.15 a.m., 1/4
his wife informed him that the deceased was lying dead on the Idaikattur to Periyakottai Main Road. He along with his wife and son went to that place and found the deceased with severe injuries on head region, his bike, was damaged. Hence, the case.
3.The learned Additional Public Prosecutor would submit that on the basis of the above said complaint, investigation was undertaken. During the course of investigation, involvement of the petitioner came to light. Hence, he was arrested and remanded to judicial custody.
4.Seeking bail earlier the petitioner has filed a petition stating that this petitioner is only friend of the first accused and he is not involved in the above said occurrence. Considering the gravity of offence, that petition was dismissed by this Court.
5.Now the learned counsel for the petitioner would submit that the petitioner is in judicial custody for more than 85 days and A1 in this case has been released on bail by the trial Court.
6.Considering the period of incarceration and the co-accused has been released on bail by the trial Court, this Court is inclined to grant bail to the petitioner on certain conditions.
7.Accordingly, this Criminal Original Petition is allowed and the petitioner is 2/4
ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Manamadurai and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
