Respondent / Respondent / Respondent Criminal Miscellaneous Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition imposed on the Petitioner by this Honble Court in Crl.MP.No.10683 of 2023 in Crl.OP.(MD).No.12408 of 2023 dt.26.7.2023 for the Petitioner shall report before Respondent Police once in a week (i.e)on every Monday at 10.30 a.m. until further orders' to 'the petitioner shall report before Learned Judicial Magistrate No.II, Madurai once in a week (i.e.) of every monday at 10.30 a.m until further orders'.

Order : This criminal miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.M.KARUNANITHI, Advocate for M/s.KALIMUTHU.P, Advocate for the petitioner and of Mr.R.SURESH KUMAR, Government Advocate (Crl. side) on behalf of the Respondent, the court made the following order:- 1/3

This Criminal Miscellaneous Petition has been filed seeking modification of the condition imposed upon the petitioner in Crl.M.P(MD) No.10683 of 2023 in Crl.O.P(MD) No.12408 of 2023, dated 26.07.2023.

2. The learned counsel for the petitioner would submit that the condition has been imposed upon the petitioner to appear before the respondent Police once in a week by the order dated 26.07.2023. Because of harassment that is made by the respondent Police during the course of investigation, the condition may be modified to the effect that to appear before the Judicial Magistrate Court No.II, Madurai.

3. The learned Government Advocate (Crl.Side) would submit that the petitioner is continuously involved in the offence under Section 307 IPC, investigation is pending.

4. Considering the submission made by the learned Government Advocate (Crl.Side), this petition is dismissed.
