2024-08-29Honourable Mr Justice D.Bharatha Chakravarthy3 pages

BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT ( Criminal Jurisdiction ) Date : 29/08/2024 PRESENT The Hon`ble Mr.Justice D.BHARATHA CHAKRAVARTHY Boobalan, ... Petitioner/Unnamed Accused Vs The Inspector of Police, Thanjavur West Police Station, Thanjavur District.

Cr.No.239 of 2024..

... Respondent/Complainant For Petitioner : M/s. Brindha.R, Advocate.

For Respondent : Mr.R.M.Anbunithi, Additional Public Prosecutor PETITION FOR BAIL UNDER SECTION 483 OF BNSS PRAYER :- For Bail in crime No.239 of 2024 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner/Accused, who was arrested and remanded to judicial custody on 06.06.2024 for the offences punishable under Sections 120B, 392, 395, 397 and 398 IPC in Crime No.239 of 2024 on the file of the respondent police, seeks bail. 1/3

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent Police.

3. Considering the fact that there are 38 previous cases against the petitioner and the petitioner is said to have been involving in similar offences throughout the State of Tamil Nadu, when this Court has granted him bail in many cases with the condition that he shall not involve in similar offences and when the petitioner gives scant respect to all those conditions imposed while bail has been granted to him in the earlier cases, the regular principle that the bail is the rule cannot be applied to the case of the petitioner when the petitioner has not complied with the earlier bail conditions with impunity and has been repeatedly involving in offences, this is not a fit case for grant of bail even though now it is stated that the detention order against the petitioner has since been revoked, I am not inclined to enlarge the petitioner on bail for the present.

4. Accordingly, this Criminal Original Petition is dismissed. sd/- 29/08/2024 / TRUE COPY / / 09 /2024 Sub-Assistant Registrar (C.S. I / II / III / IV) Madurai Bench of Madras High Court, Madurai - 625 023.
