Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 3rd respondent to submit the report before the 1st respondent as per the direction of the 2nd respondent dated 26.01.2025 and consequently directing the 1st respondent to cancel the patta in S.F.No.361/9 situated at Erachi Village, Ettayapuram Taluk, Thoothukudi District, within the stipulated time frame may be fixed by this Court. O R D E R

The writ petition is filed seeking a direction to the third respondent to submit a report before the first respondent as per the direction issued by the second respondent, dated 26.01.2025.

2.Mr.A.Baskaran, learned Additional Government Pleader takes notice for the respondents 1 to 3. Mrs.S.Meena, learned Counsel takes notice for the respondents 6 to 8. By consent of both parties, the writ petition is taken up for final disposal at the admission stage itself. Since no adverse order is passed against the fourth and fifth respondents, notice to them is dispensed with.

3.The petitioner herein filed an application seeking rectification of UDR records pertains to property situate in S.No. 361/9 in Erachi Village, Ettayapuram Taluk, Thoothukudi District. Based on the application submitted by the petitioner, the second respondent directed the third respondent to conduct an enquiry and file a report to the District Revenue Officer, Thoothukudi in his proceedings in Na.Ka.No.A2/11534/2024, dated 26.01.2025. In spite of the direction 3/6

issued by the second respondent, till date the third respondent has not conducted an enquiry and filed a report before the District Revenue Officer, Thoothukudi. Hence, the petitioner has come before this Court with the above mentioned prayer.

4.The learned Additional Government Pleader who takes notice for the respondents 1 to 3 would submit that the third respondent will file a report before the District Revenue Officer, Thoothukudi, within a time stipulated by this Court.

5.Mrs.S.Meena, learned Counsel who takes notice for the respondents 6 to 8 would submit that the private respondents shall be afforded with reasonable opportunity by the third respondent. 6.In the view of the same, without expressing any opinion on the merits of the matter, the third respondent is directed to conduct an enquiry and file a report before the District Revenue Officer, Thoothukudi, as directed by the second respondent within a period of eight weeks from the date of receipt of a copy of this order. It is made clear that the third respondent shall issue notice to the petitioner, private 4/6

respondents 4 to 8 and other interested parties and conduct an enquiry before filing a report.

7.With the above direction, this writ petition stands disposed of. No costs.
