For Petitioner :Mr.N.Sathish Babu For R1 and R2 :Mr.B.Thanga Aravindh Government Advocate (crl.side) O RDER This Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure seeking for a direction to the respondent police not to harass the petitioner on a false complaint given by the respondent Nos.3 to 5 against the petitioner.
2.It is submitted by the learned counsel for the petitioner that the wife of the petitioner No.1 and the unofficial respondent Nos.3 to 5 were doing a partnership business and during the course of said business, the respondent Nos.3 to 5 have misappropriated certain funds, on which the petitioner has filed a complaint before the respondent police and subsequently, the respondent Nos.3 to 5 were withdrawn from the partnership firm. The respondent No.5 has filed a false complaint against the petitioner and thereby, the police have been harassing the petitioner and therefore, sought for suitable directions. 2/5
3.The learned Government Advocate (Crl.side) on the other hand submits that the complaint filed by the petitioner is registered as CSR.No.205 of 2023 and similarly the complaint filed by the respondent No.5 against the petitioner is registered as CSR.No.329 of 2023 and in both the cases, enquiry is being initiated and has submitted that the same will be completed shortly. 4.Considering the submissions made by the learned counsel on either side and on perusal of the records, this Petition is disposed of directing the respondent police to complete the enquiry in both the complaints in CSR.Nos.205 and 329 of 2023 as expeditiously as possible, not later than two weeks from the date of receipt of a copy of this order.
