PRAYER :- For Bail in Crime No.634 of 2023 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner/Accused No.6 herein, who was arrested on 10.06.2023 for the alleged offence under Sections 341, 294(b), 395 and 506(ii) of IPC in Crime No.634 of 2023, on the file of the respondent police, seeks bail.

2.The case of the prosecution as per the defacto complainant's version is that on 10.06.2023, at about 7.15 in the morning, when the defacto complainant was going to his work, three persons way laid him. At the knife point, they robbed Rs.15,000/-. On the gathering of the neighbours, all the three persons fled away from the place of occurrence. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent and is no way connected with the alleged occurrence. The petitioner is in judicial custody for more than 30 days. Hence, he prays to release the petitioner on bail.

4. The learned Additional Public Prosecutor would submit that the earlier bail application is dismissed on 26.07.2023 by this Court considering the bad antecedents of the petitioner.

5.Considering the facts and circumstances of this case, even though there is no change of circumstances, considering the period of incarceration, this Court is inclined to grant bail to the petitioner with certain conditions. 6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Madurai District, and on further condition

that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
