PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, forbearing the 4th Respondent from granting permission to the Private Respondents No.5 to 9 to conduct the temple festival in "Sree Ambaratchayee Amman and Ambatta Karuppu Amman" temple schedule to be held from 13.08.2023 at Patchanampatti Village, Thiruthiyamalai Post, Musiri Taluk, Trichy District on the basis of the petitioner's representation dated 04.08.2023 and 05.08.2023.

ORDER

This Writ Petition is filed under Article 226 of the Constitution of India seeking for a Mandamus forbearing the respondent No.4 to grant the permission to the respondent Nos.5 to 9 to conduct the temple festival in "Sree Ambaratchayee Amman and Ambatta Karuppu Amman" schedule to be held from 13.08.2023 at Patchanampatti Village, Thiruthiyamalai Post, Musiri Taluk, Trichy District.

2.It is submitted by the learned counsel for the petitioner that the petitioner 2/5

and the unofficial respondent Nos.5 to 9 are the residents of Patchanampatti Village and every year, the Aadi festival will be conducted in Sree Ambaratchayee Amman and Ambatta Karuppu Amman temple and similarly, this year the festival is proposed to be held from 13.08.2023. However, the unofficial respondent Nos. 5 to 9 are not permitting the petitioner to participate and worship in the temple. 3.The learned Government Advocate (Crl.side) on the other hand submits that insofar as the worship of the temple is concerned, there is no objection from any body including the unofficial respondent Nos.5 to 9 and in case if the unofficial respondent Nos.5 to 9 raise any objections for the petitioner to worship in the temple, certainly required protection will be provided to the petitioner. It is submitted further that under the guise of worshipping the temple, the petitioner would question and raise issues in respect of the management and other things of the temple.

4.In view of the submissions made by the learned counsel on either side, this Writ Petition is disposed of directing the respondent police to provide suitable protection to the petitioner and his family members so far as worshipping 3/5

alone in the temple. The petitioner and his family members are directed to go over to the temple, worship in the temple and not to raise any issues with regard to management of the temple and in case, if they have got any grievance in respect of management of the temple, they are directed to approach the appropriate forum. No costs.
