Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to forbear the 3rd respondent from entertaining any application for approval of layouts in the property situated in Survey No.199/1A/1A/1F measuring on extent of 8.02.0 hectares in Thachankurichi Village from anybody except the petitioner on the basis of the representation of the petitioner dated 5.6.2015.

Heard the learned counsel on either side.

2. The case of the petitioner is that the petition mentioned lands should not be permitted to be plotted out. They want this Court to restrain the local body from granting any approval. It is further stated that there is pending second appeal (S.A.(MD)No.558 of 2014) pertaining to the petition mentioned land.

3. I am certain that if any application for planning approval is received by the third respondent, it would be dealt with by bearing in mind all the relevant factors. The third respondent shall put the petitioner on notice before passing any final order. 2/4
