O R D E R

The present writ petition has been filed seeking mandamus directing the second respondent to publish the result and give mark statement for the second year practical examinations for the Diploma in Teacher Education Course on the basis of the petitioner's representation dated 05.09.2022.

2. The petitioner has joined third respondent/Institution in D.T.Ed course in the academic year 2008-09. The petitioner had discontinued in the second year in the academic year 2009-10. However, the petitioner has chosen to appear for the written examinations in the second year and the results have also been published. However, due to lack of attendance for the practical classes, his results were not published by the second respondent. Hence, the present writ petition. 2/6

3. According to the learned counsel appearing for the writ petitioner, the third respondent/Institute have been called the writ petitioner to appear for the practical examinations. Therefore, the results should be published by the second respondent.

4. However, the second respondent has filed a counter to the effect that the petitioner has not attended the practical classes and lacks attendance by securing only 36%. In such circumstances, the third respondent/Institute ought not to have permitted the petitioner to appear for the practical examinations. Merely because the third respondent/Institute permitted to appear for the practical examinations, the results cannot be published by the second respondent.

5. Heard both sides and perused the records.

6. The facts indicated above make it clear that the petitioner lacks attendance in practical classes for the second year of D.T.Ed course. However, the third respondent/Institute had permitted the petitioner to appear for the practical examinations without any permission from the 3/6

respondents 1 and 2. In such circumstances, Mandamus cannot be issued to the second respondent to publish the results of the practical examinations. It is always open to the petitioner to attend the practical classes to be conducted by the third respondent and after securing proper attendance, he can appear for the practical examinations.

7. With these observations, this Writ Petition is disposed of. No costs.
