ORDER

This petition has been filed seeking to transfer the investigation in Crime No. 164 of 2024 dt 23.07.2024 on the file of the 2nd respondent and entrust the same to the some other investigation agency for investigation and to file the final report before the jurisdictional Magistrate within the time frame as fixed by this Court.

2. The learned counsel appearing for the petitioner submitted that the petitioner is the defacto complainant, on whose instance, an FIR in Crime No. 164 of 2024 was registered as against one Naveen and Others for the offences under Sections 120B, 406, 420, 294(b) & 506(2) of IPC arising out of the alleged misappropriation of a substantial sum amounting to Rs. 16 lakhs. However, since there is no progress in the investigation, this petition came to be filed.

3. The learned Government Advocate appearing for the respondent police submitted that the present case pertains to a bank transaction dispute between the petitioner and the accused. It is further submitted that the investigation in this matter will be concluded within a period of three months. 2/4

4. Heard either sides and carefully perused the materials placed before this Court.

5. On perusal of the records and also the submissions made, it is seen that due to the delay in obtaining the complete bank transactions between the petitioner and the accused persons, the investigation seems to be pending even after a lapse of two years. In this regard, the second respondent police is directed to conclude the investigation as expeditiously as possible within a period of six weeks from the date of receipt of copy of this order and also to appraise the progress of the investigation to the first respondent every Friday. The first respondent is also directed to monitor investigation from time to time.

6. With the above direction, this Criminal Original Petition is disposed of.
