Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for records pertaining to the impugned order of REF No.16502/CS/TNSTC/TNV/2024 dated 25.04.2025 passed by the third respondent, quash the same and consequently directing the respondents for allowing the Petitioner to participate in the upcoming E-Tenders to be held in the Respondents' Tamil Nadu State Transport corporation. 1/5

ORDER
This writ petition has been filed challenging the order dated 25.04.2025 passed by the third respondent and consequently directing the respondents for allowing the Petitioner to participate in the upcoming E-Tenders to be held in the Respondents' Tamil Nadu State Transport corporation.
2. It is noticed that the petitioner had participated in the e-auctions dated 29.01.2025 and 31.01.2025 for clearing the old/worn out motor vehicle parts from the third respondent. The minimum Earnest Money Deposit payable was only Rs.1,000/-.
3. It is the case of the petitioner that since bid was submitted electronically, there was a typographical error inasmuch as instead of Rs.27,000/-, inadvertently Rs.2,71,000/- was entered. Therefore, after the contract was awarded on 18.02.2025, the petitioner submitted a representation dated 10.03.2025, which was however rejected by the third respondent vide impugned communication dated 25.04.2025.

The petitioner apprehends that the third respondent will blacklist him, as he failed to fulfil the obligations under the contract awarded on 18.02.2025, which was purely on account of the mistake while typing out the bid amount electronically. It is submitted that the petitioner has filed an appeal against the aforesaid order of the third respondent dated 25.04.2025 before the first respondent on 22.07.2025.
5. Since the petitioner has already filed an appeal before the first respondent, there is no scope for quashing the impugned communication of the third respondent, dated 25.04.2025. However there shall be a direction to the first respondent to consider and dispose of the petitioner's appeal dated 22.07.2025 on merits and in accordance with law within a period of 6 weeks from the date of receipt of a copy of this order.
