PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus calling for the records on the file of the 3rd respondent in C.No.D3/14065/2025-D.O.No.565/2025, dated 27.05.2025, quash the same and to direct the 4th respondent to disburse the petitioner's pension and retirement benefits as per the pension payment order No.AG(A& E)/PEN E04/10436422/4/R0436422/532, dated 12.02.2025. ORDER
The present Writ Petition has been filed by a retired Special Sub Inspector of Police, challenging the order passed by the third respondent herein wherein pay has been revised and an order of recovery has been passed few days prior to the date of his retirement.
2.According to the learned Counsel appearing for the writ petitioner, order has been passed without issuing any prior notice to him. 2/4
3.The learned Additional Government Pleader appearing for the third respondent has submitted that the order has been passed without issuing notice to the petitioner and he prays that the matter may be remitted back to the third respondent for passing fresh orders.
4.In view of the above said facts, the order impugned in the writ petition is hereby set aside and the matter is remitted back to the file of the third respondent for passing fresh orders after giving notice to the writ petitioner and after considering the explanation submitted by the writ petitioner. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.
5.With the above said observations, this Writ Petition stands allowed. No costs. Consequently, connected Writ Miscellaneous Petition is also closed. 30.07.2025 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 3/4
