PRAYER: This Transfer Civil Miscellaneous Petition filed under Section 24 of Civil Procedure Code, to withdraw and transfer the HMOP.No.231 of 2021 from the file of Family Court, Dindigul to the file of Sub Court, Periyakulam.

O R D E R

This Transfer Civil Miscellaneous Petition has been filed to withdraw the HMOP.No.231 of 2021 from the file of the Family Court, Dindigul and transfer the same to the file of Sub Court, Periyakulam.

2.The learned counsel for the petitioner submitted that the respondent/husband filed H.M.O.P.No.231 of 2021 for divorce before the Family Court, Dindigul. Since the petitioner is residing at Thenkarai, Periyakulam Taluk, Theni District, she cannot go to Dindigul District to attend the Court hearings. Hence, she seeks to transfer the case as prayed for.

3.Considering the facts and circumstances of the case and also considering the submission made the learned counsel for the petitioner, H.M.O.P.No.231 of 2021 is ordered to be withdrawn from the file of Family Court, Dindigul and transferred to the file of Sub Court, Periyakulam.

4.In the result, this Transfer Civil Miscellaneous Petition is allowed. No costs. Consequently, connected miscellaneous petition is closed.
