Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent herein to renew/re-issue the passport in his favour on the basis of the petitioner's passport application No-MD-6075236424525 dated 03.07.2025 within the time stipulated by this Court.

ORDER

This writ petition has been filed for a Mandamus to direct the first respondent herein to renew/re-issue the passport in his favour on the basis of the petitioner's passport application No-MD-6075236424525 dated 03.07.2025.

2. The petitioner has been arrayed as an Accused No.60 in Crime No.695 of 2024 dated 31.12.2024 before the second respondent police for offences under Sections 189(2), 126(2), 285 of BNS, 2023.

3. The learned Government Advocate for the second respondent confirms that the case is still under investigation and no charge sheet has been filed till date.

4. Considering the same, there can be no impediment in directing the first respondent to process the petitioner's passport application. 2/4

5. Accordingly, the first respondent is directed to process the petitioner's passport application and issue passport as expeditiously as possible preferably within a period of 6 weeks from the date of receipt of a copy of this order. In case charge sheet is filed, the petitioner shall surrender the passport before the concerned court and thereafter retrieve the same as and when the petitioner proposes to travel abroad by filing appropriate application.
