Prayer : Criminal Original Petition filed under Section 528 of BNSS, to direct the respondents 1 and 2 herein to provide adequate police protection to the petitioner's life and limb and for his property compromised in Sy.No. 627 (old T.S.No. 48/1 - New T.S.No. 48/3) for an extent of 1.50 cents situated at Chinnamanoor Town, Uthamapalayam Taluk, Theni District, on the basis of his complaint dated 19.06.2025. 1/4

ORDER

The petitioner has filed the present petition seeking police protection to fence his property.

2. The learned counsel for the petitioner submits that respondents 4 and 5 had filed a suit in O.S.No.537 of 2004 against the petitioner in respect of the subject property, and the said suit was dismissed. However, they preferred an appeal, which, according to the learned counsel, was also dismissed in February 2024. Despite this, the respondents 4 and 5 are allegedly preventing the petitioner from fencing his property. Hence, the petitioner has filed the present petition seeking police protection.

3. This Court considered the submission of the learned counsel for the petitioner.

4.The petitioner is seeking police protection based on a decree obtained in his favour. It appears that the appeal suit filed by respondents 4 and 5 was dismissed as early as February 2024. Whether 2/4

any second appeal has been filed by respondents 4 and 5 is not known. Therefore, in the absence of any such appeal, the respondent police are directed to provide police protection, if required.
