ORDER

The petitioner is the accused person in Crime No.373 of 2025 on the file of the 2nd respondent Police. The said case was registered for the offences under Sections 296(b), 318(4), 319(2), 351(1) of BNS Act, 2023 and Sections 3(1)(r), 3(1)(s) of SC/ST (POA) Amendment Act, 2015. Therefore, the petitioner has filed this petition seeking a direction to the I Additional District Sessions Judge (Special Court for PCR), Trichy, to consider his bail application on the same day of his surrender.

2. When the matter is taken up for hearing, the learned Government Advocate (Crl. Side) submits that there is a property situated at Mekudi Village, belonging to the family of the defacto complainant's wife. Her brother and sisters intended to execute a release deed in her favour, for which the defacto complainant approached the first accused, a practicing Advocate. The first accused received all the relevant documents, and on 08.04.2025, the said release deed was registered. Thereafter, when the 2/5

defacto complainant demanded return of the documents, the first accused directed him to collect the same from the third accused. When the defacto complainant's wife approached the third accused, he demanded money for handing over the documents. Upon her refusal, the accused persons allegedly abused her in filthy language and threatened her with dire consequences.

3. Considering the conduct of the petitioner towards the defacto complainant's wife, this Court is not inclined to entertain the present petition. The 2nd respondent is directed to secure and hand over all the documents of the defacto complainant's wife from the possession of the petitioner and other accused persons, within a period of two weeks from the date of receipt of a copy of this order.

4. With the above direction, this Criminal Original Petition is dismissed.
