ORDER
Heard the learned Senior Counsel appearing for the review applicant and the learned counsel for the first respondent and the learned Additional Advocate General appearing for the official respondents.
2.Ms.D.Kothai, the daughter of Thiru.T.R.Dinakaran presented Memorandum of Settlements dated 18.04.2023 together with the settlement award dated 21.04.2023 passed by the mediator/Arbitrator Hon'ble Mr.Justice K.Kannan (Rtd.,) for registration before the SRO, Aruppukotai. The registering authority declined to register the document. Challenging the stand of the registering authority, WP(MD)No.30152 of 2023 was filed. The writ petition was allowed by me on 16.04.2023 and the petitioner was permitted to represent the document and the registering authority was directed to register the document. Seeking review of the said order, this review application 2/5
was filed by Shri.D.Senthilkumar who is the elder brother of the writ petitioner.
3.The learned Senior Counsel appearing for the review applicant would point out that the property covered in the Memorandum of Settlements belong to Ramalinga Mills Private Limited and that review applicant is very much having a definite share therein and that the writ petitioner is projecting as if by virtue of the settlement award passed, she and her mother had been given exclusive title thereon. It is too obvious that the review applicant Thiru.D.Senthilkumar was not a party to the mediation proceedings conducted by the Hon'ble Mr.Justice K.Kannan (retd) and that therefore the settlement awards that are the subject matter of these proceedings are not binding on the review applicant.
4.I clarify that the order passed by me in WP(MD)No.30152 of 2023 will operate as a shield for the petitioner and her mother against Thiru.T.R.Varadharajan family and not against the review applicant. I permit the review applicant to register the order passed by me in this review application also. I clarify that the scope of WP(MD)No.30152 of 2023 was only to cause registration of the settlement awards and that 3/5
the outcome will not have any bearing on the inter se rights of the review applicant, the writ petitioner and her mother in other proceedings.
