PRAYER :- To modify the condition in Para.6 imposed in Crl.OP(MD).No.12197 of 2025 dated 21.07.2025.
ORDER : The Court Made the following order :- This petition has been filed to modify the condition in Para.6 imposed in Crl.OP(MD).No.12197 of 2025 dated 21.07.2025.
2. The learned counsel for the petitioner would submit that the petitioner has filed an bail application before this Court on 17.07.2025 in Crl.OP.(MD).No.12197 of 2025. The said bail petition was heard and on 21.07.2025, this Hon'ble Court was pleased to grant bail to the petitioner with certain conditions. In the said bail order, Condition in Para.6 as follows:
''6. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two local sureties, each for a like sum to the satisfaction of learned Judicial Magistrate, Thuraiyur and on further conditions that :-''
3. He further submits that this petitioner is from the State of Bihar and he came 2/4
down to Tamilnadu only for his livelihood and he working as daily wager in a very meagre salary. This petitioner doesn't know any persons in the Thuraiyur locality. But, the petitioner is ready and willing to produce blood relative sureties. Therefore, the petitioner seek indulgence of this court by modifying the said condition imposed against him. Hence, he prays for modification of the said condition.
4. The learned Government Advocate (Crl.side) appearing for the respondent has not raised any objection to allow this Criminal Miscellaneous Petition.
5. Considering the submissions made by the learned Counsel for the Petitioner and being satisfied with the reasons stated above, this Court is inclined to modify the Condition in Para.6 in the order made in Crl.O.P(MD).No.12197 of 2025 dated 21.07.2025. Accordingly, Condition in Para.6 is modified as ''6. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two blood relative sureties, each for a like sum to the satisfaction of learned Judicial Magistrate, Thuraiyur and on further conditions that :-'' . The other conditions shall remain unaltered. 3/4
6. With the above said modification, this Criminal Miscellaneous Petition is allowed.
