PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, restraining the third respondent from laying the road from Enadhi to Kidathirukkai Village and consequently directing the second respondent to lay the road in 3 km patch from Enadhi to Kidathirukkai.

ORDER
(Order of the Court was made by S.M.SUBRAMANIAM, J.) The relief sought for in the Writ Petition is to restrain the third respondent from laying the road from Enadhi to Kidathirukkai Village and consequently to direct the second respondent to lay the road over a 3 km stretch from Enadhi to Kidathirukkai.
2.With reference to the prayer, the Block Development Officer, in his counter-affidavit, stated that the Divisional Engineer (H), NABARD and Rural Roads, in his letter dated 16.02.2024, had mistakenly stated that the subject road has been handed over to the Highways Department. In fact, the subject road has 2/5
not been handed over to the Highways Department, but remains under the jurisdiction of Kadaladi Union.
3.However, the learned Government Pleader appearing on behalf of the respondents would submit that sanction had already been accorded by the third respondent and a work order was issued to lay road from Enadhi to Kidathirukkai Village.
4.Since the work order has been issued, the third respondent/the Block Development Officer is directed to ensure that the laying of the road is completed as expeditiously as possible.
5.With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
