ORDER

This writ petition has been filed for a writ of Mandamus to direct the respondents to release petitioner's two wheeler vehicle bearing registration No.TN-65-BU-9803 by considering the petitioner's representation dated 16.07.2025.

2. The petitioner has wrongly impleaded the second respondent instead of the Kovilankulam Police Station, Ramanathapuram.

3. It is noticed that the petitioner was allegedly found transporting 20 bottles of alcoholic beverages contrary to the provisions of the Tamil Nadu Prohibition Act and Rules made therein under. He was intercepted while allegedly in possession of the said liquor.

4. Under these circumstances, the two wheeler bearing Registration No.TN-65-BU-9803 (TVS Jupiter) was seized from the custody of the petitioner by the officers of the Kovilankulam Police Station. The petitioner has also been served with a notice under Section 4(1)(c) of the Tamil Nadu Prohibition Act, 1937 on 18.04.2025 bearing Reference e.f.vz;. 11/gwpKjy;/J.fh.f k.tp.m.gp/,uhk/2025> pursuant to the FIR registered by the Kovilankulam Police Station, Ramanathapuram in Crime No.9 of 2025 2/5

dated 21.03.2025. The petitioner has also replied to the same on 16.07.2025. However, no orders have been passed so far.

5. Considering the same, there shall be a direction to the first respondent to provisionally release the said vehicle to the petitioner, subject to the petitioner depositing a sum of Rs.5,000/- with the first respondent.

6. It is made clear that the release of the vehicle pursuant to the order of this Court is only provisional and will be subject to the final orders to be passed by the first respondent pursuant to the show cause notice.

7. The petitioner shall also pay Rs.2,500/- to the Siddha Centre,Madurai, Madurai Bench of Madras High Court, Madurai, operated by the Registrar (Administration) (Account No.6865578219, IFSC CodeIDIB000H040, Indian Bank, High Court Branch, Madurai).
