The Petitioner herein seeks a direction to the respondent 1/5
to sub-divide and issue separate patta in the name of the Petitioner's minor son C.Danush for the property comprised in S.NO.366/1A2B, Thenkarai Village Periyakulam Taluk, Theni District by considering his representation,dated 4.8.2024. 2.Mr.D.S.Nedunchezian, learned Government Advocate takes notice for the respondent. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
3.According to the Petitioner, 20 1⁄2 cents in S.NO.336/1A2B was allotted to the Petitioner's minor son C.Danush, represented by the petitioner, in a Civil Court's decree in O.S.NO.62 of 2020, on the file of Sub-Court, Periyakulam. The Petitioner submitted the instant representation on 4.8.2024 seeking sub-division and for issuance of separate patta in her name. The same has not been considered till date. Hence the Petitioner has come before his court with the present Writ Petition for the relief stated supra. 4.Mr.D.S.Nedunchezian, learned Government Advocate who takes notice for the respondent would submit that the Petitioner has not submitted any online application and made necessary payments. Therefore, her request could not be considered. 2/5
5.In view of the same, without expressing any opinion on the merits of the matter, the Petitioner is directed to submit proper online application, make necessary payments and produce the acknowledgment for having submitted the online application before the respondent within a period of two weeks from the date of receipt of a copy of this order. On production of acknowledgment, the respondent shall consider the online application of the Petitioner and pass final orders on its own merits after affording reasonable opportunity to the Petitioner, neighbouring land owners and other interested parties, if any, within a period of 8 weeks thereafter.
6.With the above directions, the Writ Petition stands disposed of. No costs.
