This Petition is filed to condone the delay of 86 days in filing the above Civil Miscellaneous Appeal.

2. Heard the learned counsel appearing for the Petitioner. The counsel for respondents 1 and 2 has no objection to allow this petition. The learned counsel for the petitioner filed a memo stating that the notice to the 3rd respondent may be dispensed with. The said memo is recorded and his appearance is dispensed with as per the above memo.

3. In view of the no objection expressed by the learned counsel for the respondents 1 and 2 and for the reasons stated in the accompanying affidavit filed in support of the Petition and on being satisfied with the same, this Petition is allowed and the delay is condoned.
