Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned dismissal order passed by the 2nd respondent dated 07.02.2014 and quash the same as illegal and unconstitutional consequently, direct the 2nd respondent to permit the petitioner to write examination for the final semester in Diploma (Civil) 1/4

course in 2nd respondent college.

O R D E R

The present writ petition has been filed challenging the order passed by the second respondent Polytechnic College, under which, they have dismissed the writ petitioner.

2.Now, on instructions, the learned counsel appearing for the petitioner submits that if the Transfer Certificate and other Certificates are issued by the second respondent College, he is ready to redo the sixth semester afresh in a different College.

3.In view of the above said facts, this Court passes the following order:

(i)The second respondent College is directed to issue Transfer Certificate and release all the documents relevant to 2/4

the petitioner, without any adverse remarks on the petitioner. (ii)The petitioner is directed to approach the first respondent for proper permission to join in a different college. (iii)The first respondent is directed to permit the petitioner to reappear only in the papers in which he had remained absent or failed.

4.With the aforesaid directions, this Writ Petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed. 21.11.2022 Index : Yes / No Internet : Yes / No Ns To 1.The Commissioner, Directorate of Technical Education, Sardar Patel Road, Guindy, Chennai-600 025.
