This Civil Miscellaneous Petition is filed to condone the delay of 122 days in filing the Review Petition SR.No.61912 of 2025 against the order dated 21.02.2025 made in W.A.(MD).No.352 of 2025.

2. The Learned Counsel appearing for the petitioner submits that the order passed by this Court in W.A.(MD).No.352 of 2025 does not refer about Fundamental Rule 54-B, which indicates that the authority who reinstate a suspended employee, either at the time of attaining superannuation or at any other point of time, should speak about the reckoning the period of suspension. However, while disposing of the appeal, the Court has not made any observation regarding the applicability of Fundamental Rule 54-B.

3. This Court, on going through the judgment which is now sought to be reviewed with delay, find that we have already made necessary observations in paragraph No.12 of the said judgment, which are self sufficient. Therefore, there is no necessity either to condone the delay in filing the review petition or to entertain the review petition on its merits.

4. Accordingly, C.M.P.(MD).No.12458 of 2025 stands dismissed Page No.2/4

and Rev.Aplc.(MD).SR.No.61912 of 2025 is also dismissed. (Dr.G.J.,J) & (R.P.,J) 15.10.2025 Index : Yes/No.
