2. When the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondent Police, on instructions, submits that the post of the learned Judicial Magistrate No.1, Ramanathapuram, is vacant and the in-charge is the learned Judicial Magistrate No.1, Paramakudi.

3. Considering the submission made by the learned Additional Public Prosecutor appearing for the respondent Police, this Criminal Original Petition is dismissed with a liberty to the petitioner to file a fresh application after assuming the charge of the learned Judicial Magistrate No.1, Ramanathapuram.
