Order : This criminal miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.MOHAMED HASHIM A, Advocate for the petitioner and of Mr.R.SURESH KUMAR, Government Advocate (Crl. side) on behalf of the Respondent, the court made the following order:- While passing the order in Crl.O.P(MD)No.9424 of 2023, this Court directed the petitioner to appear before the trial Court namely the learned Principal Special Judge for Trial of NDPS Act Cases, Madurai, daily at 10.30 a.m. until further orders.

2. In Cr.M.P.No.9675 of 2023, the learned Principal Sessions Judge, Tirunelveli 1/3

has passed an order dated 24.07.2023, directing this petitioner to stay at Virudhunagar and report before the Virudhunagar East Police Station, daily at 10.30 a.m.

3. The learned counsel for the petitioner would submit that the petitioner could not appear before two places at the very same time, as per orders of Principal Special Judge for Trial of NDPS Act Cases, Madurai in Crime No.337 of 2022 and the learned Principal Sessions Judge, Tirunelveli and prays the condition to be modified.

4. Therefore, the condition imposed in Cr.M.P.No.9675 of 2023 by the learned Principal Sessions Judge, Tirunelveli, is modified that the petitioner can appear before the respondent police on every Sunday, until further orders.

5. Accordingly, this petition is allowed.
