PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned notice of the 3rd respondent dated 16.07.2025 and quash the same as illegal and consequently, to direct the respondents not to interfere in the peaceful possession and enjoyment of the petitioner in the land in S.No.331/1, Velvarkottai Village, Vedasenthur Taluk, Dindigul District. ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) This Writ Petition has been instituted, challenging the final notice dated 16.07.2025 issued by the 3rd respondent under Section 6 of the Tamil Nadu Land Encroachment Act, 1905 (hereinafter referred to as 'the Act'). 2.The final notice under Section 6 of the Act is susceptible to an appeal under Section 10 of the Act.

3.The learned counsel appearing for the petitioner made a submission that the appeal has already been preferred and the same is pending before the 1st respondent.

4.In view of the above, this Writ Petition is not maintainable and thus, the same is dismissed. However, the petitioner is at liberty to pursue the appeal, which is pending before the 1st respondent. No costs. Consequently, connected miscellaneous petition is closed.
