O R D E R

This writ petition has been filed seeking the issuance of a writ of mandamus, directing the respondents 1 and 2 to take necessary steps to measure the land and fix the four boundaries bearing Patta Nos.3035 and 3303 in S.F.No.478/3B, S.F.No.478/3E, S.F.No.478/3C and S.F.No. 478/3D2 situated at Kodukkampatti Village, Melur Taluk, Madurai District, belonging to the petitioner with necessary police protection, based on the petitioner's representation dated 28.07.2023.

2. Heard the learned counsel for the parties and perused the materials available on record.

3.The learned counsel appearing for the petitioner submits that a representation dated 28.07.2023 was made seeking survey and demarcation of the boundaries of the property in question. Since no action has been taken by the respondents, the present writ petition has been filed.

4. The learned Special Government Pleader appearing for the respondents submits that after considering the claims of all parties, proper steps would be taken to survey and demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

In view of the above, this Court directs the first respondent to consider and dispose of the petitioner's representation dated 28.07.2023 for survey and demarcation on merits and in accordance with law. Notice shall be issued to the petitioner, the fourth respondent and the owners of relevant adjacent lands and appropriate orders shall be passed in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act 1923, within a period of twelve weeks from today. In the event of any rival claims, the same can be agitated before the competent civil court. No costs.
