PRAYER :- For Bail in Crime No. 274 of 2021 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner/sole accused, who was arrested on 24.09.2021 for the offences punishable under Sections 366(A) of IPC and Sections 5(l), 6 of POCSO Act, 2012 in Crime No.274 of 2021 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner on false promise of marrying the victim girl had sexual relationship and thereafter refused to marry her.

3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that he is in judicial custody from 24.09.2021, hence he seeks bail.

4. The learned Additional Public Prosecutor appearing for the respondent opposed the bail petition on the ground that the victim is aged about 16 years and the petitioner is aged about 24 years. He would also submit that the victim girl in her statement recorded under Section 164(3) of Cr.P.C had alleged that the petitioner had taken the victim to Thiruparankundram, tied thali and had sexual relationship with her, due to which she became pregnant and later the same was aborted.

5. Taking into consideration the seriousness of offence said to have committed by the petitioner, this Court is not inclined to grant bail to the petitioner.
