Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for the issuance of Writ of Mandamus, to direct the first respondent, who in turn direct the second respondent police to take legal action against the accused persons based on CSR No.950/2025, dated 21.7.2025 issued by the third respondent based on petitioner's complaint dated 21.07.2025. ORDER

The petitioner, with a grievance that the respondent police has not conducted any enquiry on the complaint lodged by him, has filed this petition seeking a direction to the second respondent police to take legal action against the accused persons, based on her complaint dated 21.07.2025.

2.The learned Additional Public Prosecutor appearing for the respondent police submits that the complaint of the petitioner has been treated as a petition enquiry in C.S.R.No.950/2025. He further submits that 2/5

a counter complaint has been lodged against the petitioner and the same has also been treated as petition enquiry in CSR No.934 of 2025. According to him, both complaints were lodged only on 21.07.2025 and this writ petition has been filed on 23.07.2025, without even waiting for the outcome of the enquiry. Both the complaint and counter complaint have been received and the respondent police are conducting a preliminary enquiry to ascertain whether any criminal case is made out.

3.It appears that the complaint itself has been lodged only on 21.07.2025 and the same has been registered as petition enquiry in CSR No.950/2025. It is very unfortunate that the petitioner, without even waiting for a week, has approached this Court seeking a direction. 4.Considering the facts and circumstances of the case, the respondent police is expected to complete the preliminary enquiry within a period of two weeks from the date of receipt of a copy of this order. In the event, if any cognizable offence is made out, the respondent police is directed to register the case, otherwise, the respondent police shall close the complaint. If the complaint is closed, the respondent police is directed to furnish a copy 3/5

of the closure report to the petitioner, enabling her to workout the remedy in the manner known to law.

5.With the above directions, this Writ Petition is disposed of. No costs.
