1.The Managing Director, TWAD Board, 31, Kamarajar Salai, Chepauk, Chennai-5.

2.The Executive Engineer, TWAD Board, Kovilpatti, Tuticorin District.

... Respondents PRAYER: Writ Petitions under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 03.01.2014. For Petitioner : Mr.N.Anandakumar For R1 & R2 : Mrs.Porkodi Karnan

ORDER

The relief sought for in the present writ petition is for a direction to the respondents to consider the representation submitted by the writ petitioner on 03.01.2014.

2. The learned counsel appearing on behalf of the writ petitioner states that the writ petitioner is working as a Maintenance Assistant in TWAD Board. On account of the act of one Smt.S.Anandhavalli, the writ petitioner suffered and he made a complaint to the respondents and no action has been taken. Thus, the writ petitioner is constrained to move the present writ petition.

3.The Chief Engineer in proceedings, dated 24.06.2011 already dealt with the complaint against the said Smt.S.Anandhavalli and imposed the punishment of stoppage of increment for six months without cumulative effect. Subsequently, on appeal, the punishment was enhanced to one year stoppage of increment without cumulative effect. In view of the fact that the allegations against coemployee was dealt with by the officials concerned and punishment was imposed and therefore, the question of issuing any direction to consider the representation does not arise at all. https://hcservices.ecourts.gov.in/hcservices/

4.This Court is of the considered opinion that the complaint of the writ petitioner had already been responded and an order of punishment was also issued against the co-employee Smt.S.Anandhavalli.
