Respondents PRAYER: Writ Petition under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to regularize the period of the petitioner's service from 22.07.1994 to 31.07.1994 and consequently, permit the petitioner to be retired in the petitioner's service as Rural Welfare Officer Grade-I, Agasteeswaram Panchayat Union in the light of the judgment made in C.A.No.174 of 2002 dated 28.01.2010 as rendered by this Court and consequently, to pay all the petitioner's terminal benefits, pensionary benefits, leave salary benefits on the basis of the petitioner's representation dated 07.09.2011 forthwith. 1/3

ORDER

The learned counsel appearing on behalf of the petitioner made a submission that the petitioner died. In spite of the efforts taken by the learned counsel, he could not able to secure any instructions from the legal heirs of the deceased petitioner. Thus, the petitioner is unable to proceed with the matter. 2.In these circumstances, no purpose would be served by keeping the writ petition pending. Accordingly, this Writ Petition is closed. However, if at all the legal heirs are willing to pursue the matter, they are at liberty to restore the writ petition within a reasonable period of time. No costs. Consequently, connected miscellaneous petition is closed.
