Order : This criminal miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.ANBARASU.D, Advocate for the petitioner and of Mr.R.M.ANBUNITHI, Additional Public Prosecutor on behalf of the Respondent No.1 and of Mr.S.TITUS, Advocate on behalf of the Respondent No.2, the Court made the following order:- This petition has been filed to cancel the anticipatory bail grant by this Court in Crl.O.P.(MD)No.11642 of 2024, dated 26.07.2024.
2. Heard the learned counsel on either side and perused the material record of 1/3
the case.
3. Considering the nature of allegations which are made in the application for cancellation of anticipatory bail that the accused/ second respondent herein has got previous cases, I am of the view that this Court, while granting the anticipatory bail, had considered the same and enlarged accused on anticipated bail. Today, when the matter came up for hearing, the learned Additional Public Prosecutor also submits that the investigation is almost completed and charge sheet will be filed within a period of four weeks herefrom.
4. In that view of the matter, I am of the view that no grounds for cancelling the anticipatory bail is made out. If the second respondent herein / accused indulges in threatening the petitioner, the petitioner very well can lodge a complaint in which action can be taken with reference to the same, in accordance with law.
5. With the above observations, the Petition for cancellation of bail stands disposed of.
