PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying for a Writ of Mandamus directing the 3rd respondent shall pay the all monetary benefits and to pay all the arrears of the petitioner kept on hold at the time of superannuation dated 30.04.2024 within the period that may be stipulated by this Court.

ORDER

The instant writ petition has been filed by the Sub-Registrar seeking a mandamus to disburse all monetary benefits and pay arrears which are kept on hold even after the date of his superannuation. 2.The petitioner who was working as a Sub-Registrar was suspended by way of proceedings dated 22.04.2024 while he was about to retire on 30.04.2024. The petitioner has challenged the said suspension order before this Court in WP(MD).No.10896 of 2024. This Court by an order dated 30.04.2024 has allowed the writ petition and issued a directions to the authority, permitting the

petitioner to retire from service and dispose all the monetary, retirement and pensionary benefits.

3.It could be seen from the records, the Government has not passed any order extending the service of the writ petitioner beyond 30.04.2024. Therefore, it should be deemed that the petitioner has retired from service on 30.04.2024. Therefore, the respondent authorities are directed to release all the terminal benefits includes the pensionary benefits within a period of 12 weeks from the date of receipt of a copy of this order.

4.With the above said observations, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed. 10.09.2024 Intex : Yes/No Internet : Yes/No NCC:
