J U D G M E N T

Heard both sides.

2. The writ petitioner applied for building plan permission. It was rejected by the first respondent vide memo dated 13.03.2014. Challenging the same, this writ petition has been filed.

3. The stand taken by the local body is that the site belongs to the local temple. Objection was received from the local temple and that is why, the rejection order came to be passed. The reason set out in the impugned memo reads as follows:- 2/5

4. We are of the view that the merits of the matter need not be gone into for the present. This is because the objector / temple had already filed O.S.No.13 of 2014 on the file of the I Additional District Judge (PCR), Tiruchirappalli seeking the relief of declaration and recovery of possession. Since the parties concerned have already gone before the jurisdictional civil Court, the matter will abide by the outcome of the said civil suit. Since the suit was instituted by the temple some eight years ago, we direct the learned trial Judge to dispose of the same in accordance with law within a period of nine months from the date of receipt of a copy of this order.
