ORDER : The Court made the following order :- The petitioner/Sole Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 307 and 506(ii) of I.P.C, in Crime No.198 of 2022, seeks anticipatory bail.

2.The case of the prosecution is that on 09.09.2022, when the defacto complainant was chatting with his friends, the petitioner came to the spot and entered into a quarrel with him, abused him in filthy language and also brutally attacked him with knife. Due to which, the defacto complainant had sustained grievous injuries on his right shoulder and wrist. Hence, the complaint. 3.The learned counsel for the petitioner would submit that due to previous enmity, the present complaint has been lodged against the petitioner. The petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner shall abide any condition imposed by this Court. 4.The learned Government Advocate (Crl.side) appearing for the respondent police would submit that the petitioner is having three https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.16644 of 2022 previous case, out of which one case has been registered for the offence under Section 302 of IPC and the injured is still in hospital. He would further submit that the investigation is not yet completed and the injured still in hospital. Hence, he strongly opposed for grant of anticipatory bail.

5.Considering the nature of the offence and the fact that the injured is still taking treatment in hospital and also considering the bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
