BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED : 04.09.2024
CORAM:
THE HONOURABLE MR.JUSTICE R.SUBRAMANIAN and THE HONOURABLE MRS.JUSTICE L.VICTORIA GOWRI in W.A.(MD)SR.No.62168 of 2024 Jeyakrishnan ... Petitioner / Appellant -vs1.B.Kanniah Naidu 2.The Revenue Divisional Officer, Revenue Divisional Office, Dr.Murthy Road, Dindigul District.
... Respondents / Respondents PRAYER in C.M.P.(MD)No.12043 of 2024: Petition filed under Under Section 151 of Civil Procedure Code, to grant leave to file a Writ Appeal against the order dated 08.07.2024, in W.P.(MD)No.14992 of 2024, passed by the learned Single Judge of this Court.
PRAYER in W.A.(MD)No.SR62168 of 2024 : Writ Appeal filed under Clause 15 of Letters Patent Act, against the order made in W.P.(MD)No. 14992 of 2024 dated 08.07.2024.
For Petitioner :
Mr.R.Sundar
JUDGMENT
[Judgment of the Court was made by R.SUBRAMANIAN, J.] The order in the Writ Petition reads as follows:- "Heard the learned counsel on either side.
2.The respondent is directed to dispose of the petition mentioned appeal on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. I make it clear that I have not gone into the merits of the matter. The respondent shall put the interested persons, if any, on notice before passing final order. It is open to the respondent to pass order one way or the other.
3.The writ petition is disposed of accordingly. No costs." 2.It is the grievance of the petitioner that pursuant to the order, the respondent in the Writ Petition, has passed an order against the petitioner. If the petitioner is aggrieved by the said order, the petitioner can very well challenge the said order. Hence, we see no necessity to grant leave to challenge the order, which is inconsequential. 3.Hence, C.M.P.(MD)No.12043 of 2024 is dismissed. The Writ Appeal in W.A.(MD)No.SR62168 of 2024 stands rejected in the SR stage itself. No Costs.
