ORDER : The Court made the following order :- The petitioner/Accused Rank Not known, who apprehend arrest at the hands of the respondent police for the offences punishable under sections 85, 115(2), 351(2) of BNS and Section 4 of TNPHW Act 2002, in Crime No.Not known of 2025 on the file of the respondent police, seeks anticipatory bail.

2. Today, when the matter is taken up for hearing, the learned Government Advocate (Criminal Side), on instructions from the respondent Police, submitted that enquiry is pending in C.S.R.No.417 of 2025 against the petitioner.

3. The learned Counsel for the petitioner submitted the petitioner and the defacto complainant are husband and wife. There existed family dispute between them and the petitioner took the child with him. The petitioner is ready to hand over the child to the defacto complainant. But, the respondent police is harassing the petitioner under the guise of enquiry.

4. Considering the submissions made by the learned counsel for the petitioner and also considering the facts and circumstances of the case, the respondent police is directed to issue summons to both the parties with a direction to appear on 2/4

05.08.2025 at 10.00 a.m., and to conduct the enquiry and if any prima facie case is made out against the petitioner, register the F.I.R. or close the petition enquiry within a period of ten days thereafter.

5. Till such time, the petitioner shall not be arrested by the respondent police.
