To enlarge the petitioner on bail in C.C.No.990 2023 on the file of the Principal Special Court for EC and NDPS Act, Madurai, in connection with Crime No.265 of 2023 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/A1, who is facing a case for the offence under Sections 8(c) r/w 1/4

20(b)(ii)(C), 25, 29(1) of NDPS Act, in C.C.No.990 of 2023 on the file of the Principal Special Court for EC and NDPS Act, Madurai, in Crime No.265 of 2023 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner and other accused were found in possession of 45 kg of Ganja. Hence, the case. 3.Heard both sides.

4.Considering the nature of the allegations in this case that from the petitioner 45 kilograms of ganja was recovered and also considering the fact that the investigation is completed and the case was taken on file in C.C.No.990 of 2023 and the matter is now in the stage of trial and also considering the fact that there are totally 15 witnesses to be examined in the present case, I am not inclined to enlarge the petitioner on bail at this juncture.

5. Accordingly, this Criminal Original Petition is dismissed.

6. However, considering the fact that the petitioner is in continuous 2/4

incarceration, the learned Principal Special Court for EC and NDPS Act, Madurai, is directed to take up the case in C.C.No.990 of 2023 for early disposal and dispose of the same, in any event not later than three months from the date of receipt of a copy of this order.
