: Respondents Prayer: The Writ Petition is filed under Article 226 of the Constitution of India, seeking for Writ of Certiorarified Mandamus to call for the records relating to the impugned selection list for the post of Assessor Grade -II published by the respondent corporation on 24.02.2014 on the file of the 1st respondent and quash the same and consequently, direct the 1st respondent board to conduct fresh recruitment for the post of Assessor Grade - II. The relief sought for in the writ petition is to quash the selection list for appointment to the post of Assessor Grade-II published by the respondent Corporation on 24.02.2014 and direct the first respondent to conduct a fresh recruitment. 2.The claim of the writ petitioner is that he is fully qualified for selection to the post of Assessor Grade-II and that his case was not considered. The petitioner belongs to Hindu Scheduled Caste community and he is differently abled person with 60% of disability. Relying on the said factum, the petitioner claims that the manner in which the selection conducted by the respondent Board is improper.

W.P(MD)No.5293 of 2014 3.In respect of various grounds raised in the writ petition, the learned counsel appearing on behalf of the respondent Board brought to the notice of this Court that the writ petitioner was not even qualified for selection to the post of Assessor Grade-II. The petitioner was over aged even at the time of Selection Process. He has crossed the age of 45 years as his date of birth is 15.03.1968. Therefore, the writ petitioner was over aged at the time of selection and accordingly, not considered for appointment to the post of Assessor Grade-II. Now, the writ petition is pending for about 6 years and the petitioner is aged about 52 years as of now. This being the factual position, no further merit needs to be considered. Accordingly, the writ petition stands dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
