Mr.R.Suresh Kumar, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime No.84 of 2023 on the file of the respondent police. 1/3

ORDER : The Court made the following order :- The petitioners/Accused Nos.4 to 6, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 148, 294(b), 427, 506(2) and 109 of IPC, in Crime No.84 of 2023, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that over the previous dispute between the defacto complainant's village and Appanur Village people, on 19.07.2023 at about 10.00 p.m., the petitioners along with the other accused persons trespassed into the defacto complainant's petty shop, abused the defacto complainant in filthy language and also damaged the shop. Hence the complaint.

3. This Court has already granted anticipatory bail to the petitioners 2 and 3 dated 11.08.2023 and to verify the previous case registered against the first petitioner, this case was listed today (i.e) on 21.08.2023.

4. Today when the matter is taken up for hearing, the learned Government Advocate (Crl. Side) appearing for the respondent police submitted that in one case, compromise has been reached between the parties and the petitioner was released on his own bond before the police station. He further submitted that the petitioner has not produced any records with regard to the above said compromise.

5. Considering the facts and circumstances of this case and also considering 2/3

the submission of the learned Government Advocate and also the fact that the investigation is almost over and the final report is made ready and therefore, this Court is not inclined to grant relief of anticipatory bail to the first petitioner.
