ORDER

The learned counsel appearing for the petitioners seeks leave to withdraw this petition with liberty to raise all his defence in the trial and he has also made an endorsement to that effect. Liberty is granted.

2.In view of the above, this criminal original petition is dismissed as withdrawn. The second petitioner is a woman. She is said to be working.

Therefore, her personal appearance before the Court below is dispensed with. The learned trial Magistrate shall insist on the personal appearance of the second petitioner only when it is absolutely necessary and imperative. The second petitioner shall be called upon to appear in person before the trial Court at the time of answering the charges and at the time of examination under Section 313 of Cr.P.C., and at the time of pronouncement of Judgment. On all other occasions, the second petitioner can be represented through their counsel. It is made clear that this Court has not gone into the merits of the matter. All the contentions and defences are left open. Consequently, connected miscellaneous petitions are closed.
