For Respondent : Mr.S.Manikandan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.235/2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/Accused No.1, who apprehend arrest at the hands of the respondent Police for the offence punishable under Sections 447 of IPC and Section 3 of TNPPDL Act, in Crime No.235 of 2023 on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution that on 04.08.2023, at about 07.00 p.m, the petitioner along with the other accused person in a drunken mood, trespassed into the defacto complainant's school and also damaged the things. Hence, the complaint.

3. The learned counsel for the petitioner submits that the petitioner is an innocent persons and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to comply any stringent condition that may be imposed by the Court.

4. The learned Additional Public Prosecutor appearing for the respondent police submitted that in a drunken mood the petitioner along with the other accused trespassed into the defacto complainant's school and also damaged the things. He further submitted that one previous case is pending against the petitioner.

5. Considering the gravity of the offence committed by the petitioner and conduct of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
