Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.KARUPPASAMY PANDIYAN.G, Advocate for the petitioner and of M/S.S.RAVI, Additional Public Prosecutor on behalf of the Respondent the court made the following order:- The earlier petition filed for suspension of sentence was dismissed as withdrawn on 07.07.2022. A3 has once again preferred this petition seeking for suspension of sentence. It is brought to our notice that even during the trial, A3 was absconding for nearly four years, and hence the case was split up and A3 was tried separately. In view of this conduct on the part of A3, we are not inclined to consider this petition seeking for suspension of sentence. However, considering the nature of the issue that is involved in this criminal appeal, we are inclined to take up the main criminal appeal for final hearing.

3. There shall be a direction to the Registry to prepare the typeset of papers by calling for the records from the Court below and add this criminal appeal in the weekly list and once the typeset is made ready, the appeal itself can be taken up for final hearing.
