For Respondent : Mr.M.VAIKKAM KARUNANITHI, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.225 of 2022 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner/sole accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 323, 353 and 506(i) of IPC, in Crime No.225 of 2022, seeks anticipatory bail.
2. The case of the prosecution is that the defacto complainant engaged in Supervising the Cleaning work at SOC, at that time, the petitioner came in a drunken mood and abused the defacto complainant in filthy language, assaulted him on his cheek with hand and also obstructed him while discharging his official duties. Hence, the complaint.
3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he did not commit any offence as alleged by the prosecution.
4.The learned Government Advocate(Crl.Side) would submit that the petitioner is having two previous case and the investigation is not yet completed.

CRL OP(MD). No.16658 of 2022 5.Considering the facts and circumstances of the case and also considering the nature of offence and the bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
