Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondent No. 1 to 3 to conduct election to fillup the 6 Casual Vacancies of Directors to Board to the TUT 34 Tuticorin District Co-Operative Milk Producers Union from the existing 141 Primary Milk Producers Cooperative Societies in Tuticorin District within the time period stipulated by this Court.
ORDER :- This Writ Miscellanous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S. SURESH KUMAR, Advocate for the petitioner and 2/5
of M/s.S.P.MAHARAJAN Special Government Pleader for the respondents, this court made the following order:- This petition is filed to restore the writ petition in W.P.(MD)No.16719 of 2023 on the file of this Court.
2. Heard Mr.Sureshkumar, learned counsel for the petitioner and Mr.S.P.Maharajan, learned Special Government Pleader for the respondents 1 and 2, who has no objection for allowing this petition.
3. This Court is convinced the reasons stated in the affidavit filed in support of this petition, since the petitioner has given sufficient cause for nonappearance on that date in the writ petition for dismissed for non-prosecution. Hence, this petition is ordered.
4. Registry is directed to restore the writ petition and post it for admission in the usual course.
