... Respondent Contempt Petition filed under Section 11 of the Contempt of Courts Act, 1971, to punish the contemnor/respondent for his willful disobedience of the order passed by this Court in W.P.(MD)No.9655 of 2021 dated 07.06.2021.

Prayer in WP(MD). 9655/ 2021 :

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court S-35. To issue a Writ of Certiorarified Mandamus to call for the records on the file of the 3rd respondent pertaining to its order bearing Na.Ka.no. 10906/E4/2019 dt 23.2.2021 and to quash the same and consequently directing the respondents to approve the appointment of the petitioner in the post of B.T Assistant (Maths Malayalam) from the date of appointment that is on 28.7.2017 and consequently direct the respondents to disburse monetary and other attendant service benefits, including payment of arrears of salary from the date of appointment that is 28.7.2017 by considering the proposal submitted by the 5th respondent dt 5.8.2018 and as per the proceedings of the 4th respondent bearing Na.Ka.no.4222/A4/2019, dated 27.11.2019 within a time frame.

ORDER

Today, when the matter is taken up for consideration, the leaned Special Government Pleader appearing for the respondent submits that challenging the order passed by this Court in W.P.(MD) No.9655 of 2021 dated 07.06.2021, the respondent filed an appeal in W.A.(MD)No.2160 of 2021.

2. In view of the above, the contempt petition is closed. The petitioner could approach this Court depending upon the outcome of the writ appeal.
