PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents to pay a sum of Rs. 22,54,076/- with interest at 18% as compensation for the patta lands utilized for forming the public road without following the land acquisition Act, 1894 with respect to the lands comprised in S.Nos.157/2A, 158/1B, 177/4b, 177/5b, 177/6b, (177/19) 177/10A 177/11 and 158/2B, totally in an extent of 0.58.0 hec. situated at Sri Ramapuram revenue Village, Vedasandur Taluk, Dindigul District. ORDER
The above writ petition has been filed for the issue of a writ of Mandamus directing the respondents to pay a sum of Rs.22,54,076/- with interest at 18% as compensation for the patta lands utilized for forming the public road in respect of the land in S.Nos.157/2A, 158/1B, 177/4b, 177/5b, 177/6b, (177/19) 177/10A 177/11 and 158/2B at Sri Ramapuram revenue Village, Vedasandur Taluk, 2/5
2. Mr.Baskaran, learned Additional Advocate General assisted by Mr.B.Saravanan, learned Additional Government Pleader on instructions from the authorities states that the lands in question which is the subject matter in this writ petition has never been acquired by the authorities and it continuous to be the land of the petitioner.
3. In the light of the above submission it is open to the petitioner to continue to treat the land as his own. It is also pointed out that the land which is now shown as pathway is the private pathway of the petitioner. The Writ Petition stands disposed of, accordingly. No costs. Consequently, connected Miscellaneous Petition is closed.
