ORDER

The petitioner has filed this petition seeking a direction to the third respondent to withdraw the case in Crime No.316 of 2024 on the file of the sixth respondent and entrust the same to the fourth respondent for conducting investigation.

2.The petitioner has lost his son, who was studying in college. The petitioner's son along with two others travelled in a motor cycle, on 21.06.2024, met with an accident, suffered injuries and a case in Cr.No. 316 of 2024 has been registered on 22.06.2024. The petitioner's son subsequently died. The petitioner has filed this petition by alleging that the other two persons, who travelled along with his son, have not suffered any injuries. According to the petitioner, his son was also compelled by one Mohamed Rizwan, who travelled along with his son to rode in the vehicle and that his son is not having any role in the case in Cr.No.316 of 2024.

3.The learned Additional Public Prosecutor appearing for the respondents submits that the petitioner's son along with two others travelled in a motor cycle on 21.06.2024. All of them consumed liquor. The petitioner's son has road the vehicle, which was also recorded in CCTV footages and thereafter they have fell down and sustained injuries. It appears that they have dashed against the divider, suffered injuries, admitted in the hospital and the petitioner's son died. Since the petitioner's son has rode the vehicle, they have registered the case in 3/6

Cr.No.316 of 2024 as against the petitioner's son and they have also closed the case as charge abated. Further, the learned Additional Public Prosecutor submits that viscera report reveals the presence of the alcohol in the stomach of the deceased and CCTV footages also reveals that the petitioner's son only has rode the vehicle on the date of occurrence. 4.This Court has considered the submissions made on either side and perused the available records.

5.The petitioner is an unfortunate father, who has lost his son. The accident might have been occurred due to the act of the deceased. The investigating agency is directed to furnish the copies of the CCTV footages and viscera report to the petitioner enabling him to satisfy the reasons for the accident. With this observation and direction, this writ petition is closed. No costs. Consequently, connected miscellaneous petition is closed.
